Terms of Service

The terms on which you may use this website and the BSI Calculator, what a reading is, what it is not, and who stands behind it.

1. Who These Terms Are With

This website is operated by Khufu Management Pty Ltd, an Australian proprietary company trading as BlackSnow Intelligence. These terms form an agreement between you and that company, and they apply whenever you use this website or the BSI Calculator.

Where we deliver a paid engagement, the engagement agreement governs it and these terms cover only your use of this website. Where we process personal data on your behalf, our Data Processing Terms apply as well.

2. What This Website Offers

This website publishes our method, our research position and a free tool. Using it is free and requires no account. You accept these terms by using the site; if you do not accept them, do not use it.

3. The BSI Calculator, And What A Reading Is Not

The BSI Calculator fetches pages an organisation has published at its own address, strips the markup, and applies a fixed, versioned rule set to the text. It reads only what is already public. It signs in to nothing, submits no form, and executes no code from the pages it reads.

A reading is an observation of published documents at a moment in time. It is not legal advice, not an audit, not a certification, not a credit or risk rating, and not a statement about what an organisation does internally. An organisation may hold a control it has never published; the reading records that the control was not found in what was published, which is a different finding and is worded as one.

You must not rely on a reading as the sole basis for a decision about another party, and you must not present a reading as our opinion of that party. If a reading matters to a decision you are making, verify it against the source documents it names.

4. Acceptable Use

You may run the BSI Calculator against any address, including addresses belonging to organisations other than your own, because it reads only public pages. In using this website you agree not to:

  • submit an address you know to be a private, internal or non-public system;
  • use the service to place load on a third party, or to run volumes that would amount to that;
  • attempt to bypass a rate limit, probe our infrastructure, or interfere with the service for anyone else;
  • scrape, republish or resell readings as a dataset or as a ranking of organisations;
  • present a reading as a certification, a score awarded by us, or a statement of legal compliance; or
  • use the service in breach of a law that applies to you.

We may rate-limit, suspend or refuse access where use breaches this section, and we will say why if you ask.

5. Keeping Your Assessments

The calculator can keep a list of the checks you have run. That list is held in your own browser and is described in our Cookie Notice. Giving us a name and an address is optional, and what happens to it is set out in our Privacy Notice. There is no account to create, no password to set and no login, so nothing here can be taken over.

6. Our Material

The method, the rule sets, the wording of this site, the research documents and the design of the readings are our intellectual property or licensed to us. You may read them, quote them with attribution, and share a link to them. You may not copy the method or the rule sets into a competing product, and you may not remove the attribution from a document we publish.

Naming an organisation in a reading is neither an endorsement of it nor a claim on its marks. Every third party name appears as a factual reference to material that party published.

7. What You Submit

You keep whatever rights you have in the addresses and details you submit. You give us permission to use them to run the service and to record what the service found, on the terms in our Privacy Notice. Do not submit anything confidential through this website; it is not built to receive confidential material, and nothing on it is a secure channel for it.

8. Availability

This is a free service published by a small business. We give no availability commitment for it, we may change it or withdraw it, and we may change the rule set that produces a reading. Where the rule set changes, the version identifier on a reading changes with it, so two readings taken at different times can always be told apart. Paid engagements carry their own service commitments in their own agreement.

9. Warranties

We warrant that we will provide the service with reasonable care and skill, and that we will not knowingly publish a finding we cannot evidence from a source we name.

Beyond that, and to the extent the law allows us to say so, this website and the BSI Calculator are provided as they are, with no warranty that a reading is complete, that it is current, or that it is fit for a particular purpose. A reading depends on what a third party published and on what their site returned to our request at that moment, and neither is within our control.

Nothing in these terms excludes a warranty, guarantee or right that cannot lawfully be excluded, including the consumer guarantees in the Australian Consumer Law. Where a guarantee applies and cannot be excluded, our liability is limited to resupplying the service or paying the cost of having it resupplied.

10. Liability

Neither party excludes liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not permit to be excluded.

Subject to that, we are not liable for indirect or consequential loss, for lost profit, lost business, lost goodwill or lost data, or for a decision you or anyone else took on the basis of a reading. Our total liability arising out of your use of this free service is limited to one hundred Australian dollars, which reflects that no fee is paid for it. Liability under a paid engagement is governed by that engagement's own agreement and is not limited by this section.

11. Automated Decision-Making

We carry out no automated decision-making that produces a legal effect concerning any individual, and we carry out no profiling. A calculator reading is a description of published documents, not a decision about a person, and no model is involved in producing it. Our position on models is published in full in our AI Policy.

12. If You Think A Reading Is Wrong

Write to ror@blacksnowintel.com with the address, the date of the reading and what you say is wrong. We will re-run the read, tell you what the current rule set finds, and correct any error we have made. If a document exists and our read did not reach it, tell us where it is published and we will say plainly whether the read could reach it and why.

13. Privacy

What we collect, why, on what lawful basis and for how long is set out in our Privacy Notice. The parties that handle data on our behalf are named on our Sub-Processors page, and our controls are described in our Security Overview.

14. Changes To These Terms

This is version 1.0, published on 17 August 2026. We publish a changed version at this address with a new version number and date. Continuing to use the website after a change means the changed terms apply to that use. A change never applies retrospectively to a paid engagement already under way.

15. Governing Law And Jurisdiction

The governing law of this agreement is the law of Queensland, Australia, and the courts of Queensland have non-exclusive jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory law of the place you live, or of the right to bring a claim there.
